Your Closed Head Injury and Georgia Workers’ Compensation Claim
Closed head injuries can be some of the most devastating and costly work injuries that can occur. Sometimes the injured worker regains the capacity to return to some type of work and sometimes the head injury permanently disables the injured worker.
Often, when I deal with a closed head injury case, I advise my client about both workers’ compensation and Social Security disability, since a serious closed head injury could leave you unable to resume full time work.
The Georgia workers’ compensation system is not designed to provide for injured workers with chronic or life-long problems. When I estimate the likely lifetime costs of caring for a person who may have both physical and emotional or mental health needs, the expenditures can run into the hundreds of thousands of dollars. Workers’ compensation insurance companies will often agree to pay for the physical injuries, but will try to avoid paying for counseling, home modification and other associated treatment.
If we decide to settle, we will also have to deal with Medicare and the “Medicare set aside” - whereby Medicare will demand that a portion of your settlement be set aside to cover future medical costs.
